S’indagano alcuni aspetti della riflessione di Weber con particolare riguardo alle osservazioni relative all’intreccio tra politica e diritto che si crea nell’emergenza, a cui il sociologo si dedicò nei suoi ultimi mesi di vita e di ricerca. Tale prospettiva consente di misurare l’attualità del pensiero di Weber con riguardo alla stretta relazione che egli volle stabilire tra «trasformazioni» ed «emergenze». In particolare si considerano alcune questioni che riguardano la terza forma di «dominio» (Herrschaft) legittimo, che non è né quella tradizionale, né quella carismatica, ma quella che talvolta, ma non sempre, Weber ha chiamato «legale».
Some aspects of Weber’s reflection will be investigated with particular regard to the intertwining of politics and law that is created in emergencies, to which he devoted himself in the last months of his life and research. This perspective allows to measure the topicality of Weber’s thought with regard to the close relationship that he wanted to define between «transformations» and «emergencies». In particular, we consider some issues concerning the third form of legitimate ‘domination’ (Herrschaft), which is neither the traditional nor the charismatic one, but what Weber sometimes, but not always, called ‘legal’.
