In recent years, most western societies have been experiencing a marked crisis of legality: should this be viewed as a temporary phenomenon or an unavoidable decline? The paper stems from the consideration that the most common approaches to studying this crisis focus on a limited number of aspects and miss out others which are just as important when it comes to gaining a full understanding of the phenomenon. We therefore explore classic works (Weber, Simmel, Tocqueville) and later studies (Eisenstadt, Polanyi) to take a wider approach to the question of legality, interpreted as resulting from social construction and deconstruction.
